Wells Fargo Bank seeks removal of allegations to US District Court

PALM BEACH — Wells Fargo Bank seeks to remove a lawsuit to federal court, citing allegations of federal law as reason for removal.

Wells Fargo Bank filed a notice of removal on Dec. 23, 2015, to the U.S. District Court for the West Palm Beach Division of the Southern District of Florida for a case originally filed against them by Abid Rahman, citing the Truth In Lending Act (TILA) as grounds for removal.

According to the notice of removal, Rahman originally filed the claim on Nov. 19, 2015, in the County Court of the 15th Judicial Circuit against the defendant. The sole count of the complaint was based upon an alleged TILA violation pursuant to federal jurisdiction, which the defendant refers to as reason for removal.

The defendant seeks removal of the action pending in the 15th Judicial Circuit Court to the U.S. District Court for the West Palm Beach Division of the Southern District of Florida. They are represented by Emily Y. Rottmann, Sara F. Holladay-Tobias and Gabriel M. Hartsell in Jacksonville.
