Nursing Home Accused of Negligence Leading to Resident's Death

The Estate of Renate B. Seamans has filed a lawsuit against a Florida nursing home, alleging negligence and breach of fiduciary duty leading to the wrongful death of Renate B. Seamans. The complaint was filed by Angela Erika Alma Seamans, the personal representative of the estate, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida on May 1, 2025, targeting CPlace of St. Pete LLC, Ark Post Acute Network LLC, and Raymond Daniel Charpentier.

According to the complaint, Renate B. Seamans was admitted to Carrington Place of St. Pete on April 4, 2023, where she resided until her discharge on January 25, 2024. The plaintiff alleges that during her stay at the facility owned by CPlace of St. Pete LLC and managed by Ark Post Acute Network LLC with Raymond Daniel Charpentier as administrator, Renate B. Seamans suffered due to inadequate care and supervision. The lawsuit claims that these entities failed to maintain sufficient staffing levels and did not provide proper medical attention or a safe environment for residents like Ms. Seamans.

Angela Erika Alma Seamans argues that these failures violated Florida Statute 400.022 concerning residents' rights in nursing homes and led directly to Ms. Seamans's suffering and eventual death on January 25, 2024. "Defendants breached their duty...to properly supervise staff," states the complaint while accusing them of prioritizing financial gains over resident welfare by accepting more residents than they could adequately care for.

The lawsuit seeks damages exceeding $50,000 for non-lethal negligence, lethal negligence resulting in survival damages, wrongful death damages under Florida law as well as disgorgement of profits from CPlace of St. Pete LLC for breach of fiduciary duty. Additionally, it accuses Ark Post Acute Network LLC of aiding and abetting this breach by controlling finances in ways detrimental to resident care.

Plaintiff’s attorney Carl R. Wilander from Mendes Reins & Wilander PLLC represents the estate in this case identified as Case Number: 25-002306-CI before a circuit judge who appointed Angela Erika Alma Seamans as personal representative on March 19th after determining her qualification according to state statutes governing such appointments.
