The complaint was lodged in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on April 1, 2025. Cross alleges that both companies failed to maintain safe conditions at their arcade location in West Palm Beach County.
According to the complaint, Cutbirth Cross was visiting the premises located at 5096 Forest Hill Blvd Suite 200 as a business invitee on July 23, 2024. During his visit, he sat on a stool that was allegedly defective or broken, causing him to fall and sustain injuries. The plaintiff asserts that both defendants had a non-delegable duty to ensure the safety of their premises by maintaining it in a reasonably safe condition and warning visitors of any known dangers.
Cross's legal team argues that the defendants breached this duty through various acts of negligence. These include failing to maintain or inspect the sitting stools adequately, neglecting to warn about the dangerous condition of the stool, and not correcting or repairing it despite being aware of its faulty state. The complaint further accuses the defendants of inadequate staffing and training concerning safety inspections and failing to adhere to corporate policies regarding maintenance.
The injuries sustained by Cross are described as severe and permanent, affecting his ability to enjoy life and work. He is seeking damages exceeding $50,000 for bodily injury, pain and suffering, mental anguish, medical expenses, loss of earnings, and other related losses. Additionally, Cross demands a jury trial for all issues so triable.
