The case revolves around an incident that occurred on April 30, 2023. On this date, Rodriguez was visiting a resident at the Palo Verde premises located at 6212 Forest Hill Blvd., West Palm Beach. While taking out trash to the complex's dumpster, she tripped over large tree branches and debris left on the ground amidst poor lighting conditions. This fall resulted in serious bodily injury to Rodriguez. She contends that both YMP Real Estate Management and YMP Palo Verde were responsible for maintaining the premises in a safe condition but failed to do so.
Rodriguez's complaint accuses both companies of negligence for not addressing hazardous conditions they knew or should have known about. "Defendant YMP REAL ESTATE had a duty to maintain the premises in a reasonably safe condition," reads one part of the complaint. Similarly, it states that Defendant PALO VERDE "failed to exercise due care" and did not adequately inspect or correct unsafe conditions on their property.
The plaintiff claims these oversights directly led to her injuries and subsequent pain and suffering. The legal filing describes damages including disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, and medical expenses incurred due to her injuries. It also suggests these losses are either permanent or will continue into the future.
