A woman has filed a lawsuit against a motor company, alleging negligence after suffering injuries from tripping over an obstruction in a parking lot. Rosalind Panitz initiated the complaint on February 28, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Gunther Motor Company of Plantation, Inc., and Gunther Motor Company New Ventures, LLC.

The lawsuit claims that on February 27, 2024, Panitz was legally present at the Gunther Volkswagen Delray Beach location when she tripped over an elevated obstruction in the parking lot. The plaintiff argues that both defendants had a duty to maintain the premises safely and failed to do so by allowing or failing to remove this hazard. The complaint details that this failure resulted in serious and permanent bodily injuries for Panitz. It further alleges that the defendants knew or should have known about the dangerous condition due to its regular occurrence and failed to take necessary corrective actions.

Panitz accuses both entities of breaching their duty of care by not maintaining the parking lot in a reasonably safe condition, failing to correct any hazardous conditions they were aware of or should have been aware of through reasonable care, and neglecting to warn her about these dangers. As a result of these alleged failures, Panitz suffered significant injuries including pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, and financial losses related to medical expenses and lost earnings.

The plaintiff is seeking damages exceeding $50,000 from each defendant along with taxable costs. She demands compensation for her physical injuries as well as economic losses such as past and future medical expenses and lost wages. The lawsuit also requests any additional relief deemed appropriate by the court.
