A woman has filed a lawsuit against a major supermarket chain, alleging negligence after a slip-and-fall incident left her with severe injuries. Swany Guillen Orozco lodged the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on February 17, 2025, targeting Publix Super Markets, Inc.
According to the court documents, Swany Guillen Orozco was visiting a Publix store located at 1968 NE 5th Ave., Boca Raton, Florida on October 10, 2024. During her visit as a business invitee—a legal term indicating she was lawfully on the premises—Orozco slipped and fell due to liquid that had accumulated on the floor near the soup bar. The complaint asserts that Publix Super Markets failed in its duty to maintain a safe environment for its customers. "Defendant owed to its business invitees a duty to provide a reasonably safe environment," reads one part of the filing.
The lawsuit details multiple alleged failures by Publix Super Markets: not maintaining the floor in a safe condition by allowing liquid accumulation; failing to warn Orozco of this dangerous condition; neglecting timely inspections of hazardous areas; and not placing wet floor signs or other warning devices. Furthermore, it accuses Publix of failing to remove the liquid from the floor and not correcting what it describes as an obvious hazard.
Orozco claims that these oversights led directly to her fall and subsequent injuries. The document states she suffered "severe injuries, physical and mental pain and suffering," along with "disability, physical impairment, disfigurement," among other ailments. It further notes that these injuries are either permanent or continuing in nature and have resulted in hospital bills and other medical expenses.
The plaintiff is seeking damages exceeding $75,000 exclusive of interest and costs. She demands judgment for damages and costs from Publix Super Markets along with any additional relief deemed appropriate by the court. The complaint also requests a jury trial for all issues triable as a matter of right.
