Subaru accused of Breach of Warranty by Florida Resident Over Defective Vehicle

A Florida resident has taken legal action against a major automobile manufacturer, alleging breach of warranty and seeking damages for a defective vehicle. The complaint was filed by Kella Fuentes in the Circuit Court for Palm Beach County, Florida, on February 18, 2025, against Subaru of America, Inc.

The case revolves around a 2022 Subaru Outback purchased by Fuentes from Schumacher Subaru on June 23, 2022. According to the complaint, the vehicle was plagued with defects that impaired its use and safety despite multiple repair attempts by authorized dealers. Fuentes claims that these issues persisted even after three repair attempts, rendering the vehicle unreliable and unsafe. "Plaintiff justifiably lost confidence in the Outback’s safety and/or reliability," states the complaint. The plaintiff accuses Subaru of failing to fulfill its obligations under the Magnuson-Moss Warranty Act and Florida's warranty laws by not adequately repairing or replacing the defective vehicle within a reasonable time frame.

Fuentes is seeking damages exceeding $50,000 for breach of written warranty under federal law. The lawsuit demands reimbursement for costs associated with the vehicle's purchase and repairs, as well as incidental and consequential damages. Additionally, Fuentes seeks attorney fees and court costs incurred due to Subaru's alleged failure to comply with its warranty provisions.
