Plaintiff Alleges Negligence Against Retail Giant Walmart Following Slip-and-Fall Incident

A slip-and-fall incident at a major retail store has led to a lawsuit that could set significant precedents for customer safety standards. Beatriz Osorio filed a complaint against Walmart, Inc. in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on February 18, 2025. The lawsuit accuses Walmart of negligence resulting in injuries sustained by Osorio during a shopping trip.

The case revolves around an incident that occurred on November 12, 2023, when Beatriz Osorio was shopping at a Walmart store located on State Road 60 in Lake Whales, Florida. According to the complaint, as Osorio walked through the aisles of the store, she slipped and fell due to a large amount of poultry liquid that had accumulated on the floor. This hazardous condition allegedly caused her to strike her left knee on the ground, leading to various injuries. The plaintiff asserts that Walmart failed in its duty to maintain safe premises for its customers by allowing such dangerous conditions to exist.

Osorio's complaint outlines several allegations against Walmart. It claims that the company breached its non-delegable duty by failing to prevent or address the accumulation of poultry liquid on the floor and not warning customers about it. The complaint states that Walmart did not take reasonable care in maintaining their premises safely and failed to conduct adequate inspections or place warning signs around hazardous areas. As per Osorio's legal team, these failures directly contributed to her fall and subsequent injuries.

In terms of relief sought from the court, Beatriz Osorio is demanding judgment for damages exceeding $50,000 exclusive of interest and costs. She is seeking compensation for bodily injuries, pain and suffering, disability, disfigurement, loss of capacity for enjoyment of life, inconvenience, medical expenses, rehabilitation costs, loss of wages and insurability among other losses. Furthermore, she requests a trial by jury for all issues triable as a matter of right.
