The incident occurred on July 31, 2023, when Patti Weaver visited a Publix store located at 1538 South Federal Highway in Delray, Palm Beach County. As a business invitee exercising due care for her safety, Weaver slipped on a liquid substance on the floor while shopping. The complaint alleges that this was due to the careless and negligent maintenance of the floors by Publix and its employees. Weaver asserts that Publix had a duty to keep the premises safe and warn patrons of any dangerous conditions but failed to do so.
Weaver's complaint outlines several specific accusations against Publix. It accuses the company of negligently failing to maintain or adequately inspect the flooring, creating an unreasonably dangerous condition for customers like herself. Furthermore, it claims that Publix did not have adequate staff assigned to inspect and maintain the floors or train employees properly regarding these duties. The lawsuit also alleges that Publix neglected its corporate policies related to floor safety and failed to enforce them effectively.
As a result of this alleged negligence, Weaver sustained significant personal injuries leading to pain and suffering, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings, and other economic damages. Weaver seeks judgment against Publix for damages exceeding $50,000 exclusive of interest and costs. She is also asking for additional relief deemed appropriate by the court and demands a trial by jury for all issues triable by right.
