Beatriz Osorio, a shopper in Palm Beach County, Florida, has filed a lawsuit against retail giant Walmart after suffering injuries from a slip and fall incident at one of their stores. The complaint was officially filed on February 18, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County. Osorio is seeking damages exceeding $50,000 from Walmart, alleging negligence on the part of the store.
The incident occurred on November 12, 2023, when Osorio was shopping at the Walmart located on State Road 60 in Lake Whales, Florida. According to the complaint, as she navigated through the aisles, she unexpectedly slipped and fell due to a large amount of poultry liquid that had accumulated on the floor. This hazardous condition led to her striking her left knee against the ground. The lawsuit claims that Walmart failed to maintain safe premises by allowing such dangerous conditions to exist without adequate warning or preventive measures.
Osorio's legal team argues that Walmart breached its duty of care by not ensuring a safe environment for its customers. The complaint outlines several failures by Walmart and its employees: they allegedly did not clean up or warn about the slippery poultry liquid; they neglected to use reasonable care in maintaining safe premises; and they failed to conduct proper inspections or place warning signs around hazardous areas. These oversights are claimed to have directly contributed to Osorio's injuries.
As a result of her fall, Osorio suffered various physical injuries leading to pain and suffering, disability, disfigurement, loss of enjoyment of life, inconvenience, and incurred medical expenses. She also claims losses related to earning capacity and wages due to her injuries. The lawsuit emphasizes that these damages are either permanent or will continue into the future.
Osorio is represented by Michael Cecere and Asheley Y. Santana from Cecere Santana P.A., along with Scott F. Grady from Scott F. Grady P.A., serving as co-counsel. They are seeking judgment for damages plus costs against Walmart and have demanded a trial by jury for all issues eligible for such proceedings under Florida law. The case ID is: 502025CA001505XXXAMB Div: AK.
