According to the complaint, Tyner was walking near the intersection of Avenue P and 13th Street in Riviera Beach when she stepped into an uncovered hole owned by the city. The absence of a steel cover over the hole led to serious injuries for Tyner. The lawsuit claims that after the incident, the city placed the cover back onto the hole. The plaintiff argues that this negligence is evident as "the steel cover can easily be removed by any passerby," which poses a foreseeable risk to pedestrians.
Tyner's complaint accuses the City of Riviera Beach of failing to maintain public property safely and neglecting its duty to warn citizens about potential hazards. She asserts that "Defendant owed Plaintiff a duty of care" to ensure such areas were secure and safe for public use. The failure to maintain or properly inspect these areas constitutes a breach of this duty. Tyner alleges that this breach resulted in her suffering "bodily injuries and resulting pain and suffering," along with other damages such as disability, mental anguish, and loss of enjoyment of life.
In her lawsuit, Tyner seeks both general and special damages from the court.
