Plaintiff alleges negligence against pet retail giant over slip-and-fall incident

Yvonne Miller has filed a lawsuit against a major pet retail chain and one of its store managers, alleging negligence after suffering injuries from a slip-and-fall incident. The complaint was lodged in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on February 4, 2025, targeting PetSmart, LLC and an individual identified as Jane Doe.

The plaintiff, Yvonne Miller, claims that on July 29, 2023, she visited a PetSmart store located at 1875 Palm Beach Lakes Boulevard in West Palm Beach. During her visit, she slipped on a liquid substance that had leaked onto the floor near the front of the store behind the registers. Miller alleges that this hazardous condition resulted from negligence on the part of PetSmart and its manager, Jane Doe. According to the complaint, both defendants failed to maintain safe premises by allowing such conditions to persist without adequate warning or remediation.

Miller's lawsuit outlines several specific allegations against PetSmart. These include failing to maintain their premises safely by allowing liquid spills to create slip hazards for customers like Miller. The complaint further accuses PetSmart of neglecting to inspect their premises for dangerous conditions and failing to warn customers about potential risks. Additionally, it is alleged that PetSmart did not correct or repair these hazardous conditions promptly.

Similarly, Jane Doe is accused of being directly responsible for maintaining and operating the store according to company policies and procedures. The complaint charges her with failing to prevent foreseeable injuries by neglecting proper inspection and maintenance practices. It also claims she did not adequately train or supervise employees regarding customer safety measures.

As a result of these alleged acts of negligence by both defendants, Miller asserts she suffered significant bodily injury leading to pain and suffering, disability, disfigurement, mental anguish among other damages which are either permanent or continuing in nature. She seeks compensation exceeding $50,000 along with interest costs related expenses incurred due medical treatment hospitalization loss earnings capacity enjoyment life etc., while demanding trial jury all issues so triable.
