Target accused of negligence by customer following alleged injury at store

A Palm Beach County resident has taken legal action against a major retail corporation and its store manager, claiming negligence that resulted in significant injuries. Desaundrei Chung Hill filed the complaint on February 6, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, naming Target and an employee referred to as Jane Doe as defendants.

According to the lawsuit, Hill visited a Target store in Palm Beach County on February 8, 2023. During this visit, she was allegedly injured due to what she claims was negligence on the part of both Target and its manager. The complaint states that Target and Jane Doe had a duty to maintain their premises safely for customers but failed to do so. "Defendants negligently failed to use reasonable care for the safety of the Plaintiff," reads the filing.

Hill's complaint details that she suffered "bodily injury including a permanent injury to the body as a whole," along with other physical and mental damages such as pain and suffering, disability, disfigurement, mental anguish, and loss of earnings. The lawsuit asserts that these injuries are either permanent or will continue into the future.

The plaintiff accuses Target of breaching its non-delegable duty by not maintaining safe conditions for its invitees. Similarly, Jane Doe is accused of failing in her responsibilities as a manager at Target. Hill’s legal representation cites previous cases like White v. Wal-Mart Stores and Orlovsky v. Solid Surf to argue Jane Doe's personal liability due to her managerial role.

Desaundrei Chung Hill seeks judgment exceeding $50,001 from both defendants for damages incurred from her injuries. She also requests interest, costs associated with the case, attorney fees where applicable by law, and any additional relief deemed appropriate by the court.
