The complaint was filed on February 1, 2025, against Anna Lasalle and Jolanta Grudzinska, both residents of Palm Beach County.
The lawsuit centers around a condominium unit owned by Rasaluch LLC at Boca Cove in Boca Raton, Florida. According to the complaint, the defendants own the unit directly above Rasaluch's property. In July 2024, a significant flooding incident occurred in Rasaluch's unit due to water intrusion from the defendants' unit. This event allegedly caused extensive water and mold damage to Rasaluch's property. The plaintiff claims that this damage resulted from the defendants' failure to maintain their unit properly.
Rasaluch LLC asserts that Lasalle and Grudzinska were responsible for ensuring their property's fixtures were in working order and compliant with Boca Cove Condominium's rules. The complaint alleges that both defendants failed to carry adequate insurance coverage as required by the condominium’s governing documents. "Defendants have breached their obligations under Boca Cove Condominium’s governing documents," states the complaint.
In addition to seeking damages exceeding $50,000 for repair costs and lost rental income, Rasaluch LLC is pursuing attorney fees and other legal costs under Florida Statutes Chapter 718. The plaintiff argues that they are entitled to these fees due to the defendants' negligence and breach of contract.
