The case revolves around an incident on March 8, 2024, when Radmanesh sustained a 6 cm laceration on his left leg while attempting to climb over a wooden fence. Seeking medical attention at Orlando Health Emergency Room Pinellas Park, he was treated by Dr. Martino who sutured the wound and prescribed antibiotics. However, Radmanesh returned to the emergency room twice over the following days with worsening symptoms including severe pain and swelling. On March 10, he was diagnosed with cellulitis and admitted to Orlando Health Bayfront Hospital for further treatment involving surgical procedures due to debris found in his wound.
Radmanesh's lawsuit accuses Dr. Martino of failing to properly examine and treat his injury by not removing foreign bodies from the wound or conducting necessary diagnostic tests such as ultrasounds or CT scans before closing it with sutures. The complaint asserts that these oversights constituted a breach of duty owed by Dr. Martino as a healthcare provider and directly resulted in Radmanesh's prolonged suffering and subsequent hospitalization.
The plaintiff is seeking damages exceeding $50,000 for bodily injury, pain and suffering, mental anguish, loss of enjoyment of life, medical expenses, and diminished earning capacity—losses he claims are permanent or ongoing. The lawsuit also holds Orlando Health Emergency Room vicariously liable for Dr. Martino’s alleged negligence as she was acting within her role as their agent or employee during the incident.
