Ellen Holmes, a vulnerable 78-year-old resident of an assisted living facility, has filed a lawsuit alleging negligence and abuse at the hands of her caregivers. The complaint was filed by Holmes on January 31, 2025, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Tarpon Springs Assisted Living at Walton Place LLC.

The lawsuit details that Ellen Holmes was a resident at Walton Place from February 6 to February 29, 2024. During her stay, she suffered a fall resulting in serious injuries including a fractured humerus and jaw. The plaintiff accuses the defendant of failing to provide adequate care and supervision, leading to unnecessary pain and suffering. According to the complaint, Tarpon Springs Assisted Living at Walton Place LLC had a duty to protect its residents from harm but failed in its responsibilities by not preventing falls or ensuring proper hygiene and healthcare for Holmes.

Holmes' legal team argues that the facility engaged in negligent practices such as inadequate staffing levels to maximize revenue without regard for resident safety. The complaint highlights several violations of Florida Statute §429 and common law, asserting that these failures directly led to Holmes' injuries. Furthermore, it claims that the facility falsely advertised itself as providing "twenty-four-hour care from a dedicated staff," thus misleading residents about their level of safety and care.

The plaintiff seeks damages exceeding $50,000 for physical injuries, pain and suffering, mental anguish, and medical expenses incurred due to the alleged negligence. Ellen Holmes demands judgment against Tarpon Springs Assisted Living at Walton Place LLC for these damages along with any other relief deemed appropriate by the court.
