Calvin Bowens has filed a lawsuit against Wawa, Inc., a foreign profit corporation, claiming negligence and seeking damages exceeding $50,000. The complaint was filed on January 23, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida.
The case centers around an incident that occurred on July 11, 2024, when Bowens visited a Wawa store located at 2370 45th Street in West Palm Beach as a business invitee. According to the complaint, Wawa was responsible for maintaining the premises in a safe condition but failed to do so. Bowens alleges that he slipped and fell on a liquid substance near the entrance of the store due to negligent maintenance by Wawa. The complaint outlines several alleged failures by Wawa, including not adequately maintaining or inspecting the flooring and failing to warn customers of potential hazards.
Bowens claims that as a result of Wawa's negligence, he suffered significant personal injuries. These injuries include bodily harm resulting in pain and suffering, disability, disfigurement, permanent scarring, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings and earning capacity, and aggravation of pre-existing conditions. The plaintiff argues that these losses are either permanent or ongoing and will continue to affect him in the future.
In his lawsuit against Wawa Inc., Bowens is seeking damages exceeding $50,001 plus interest and costs. He also demands a jury trial for all issues triable by jury. Representing Bowens is attorney Michael Pipitone from Morgan & Morgan P.A., who submitted the complaint on January 22nd.
