Elise Nerenberg has filed a lawsuit against a painting contractor, alleging negligence after a slip-and-fall incident left her with serious injuries. The complaint was lodged in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on January 23, 2025, targeting Roof Painting by Hartzell, Inc., doing business as Hartzell Painting.
According to the complaint, Elise Nerenberg claims that on October 27, 2024, she suffered significant injuries due to slipping on wet paint negligently left unattended by Hartzell Painting at Century Village Community. The plaintiff asserts that Hartzell had a duty to ensure the safety of individuals on their premises and failed to exercise reasonable care by allowing hazardous conditions to persist. Nerenberg alleges that the defendant either knew or should have known about the dangerous condition due to its regular occurrence or prolonged existence.
The lawsuit details several accusations against Hartzell Painting. It states that the company breached its duty by "negligently creating and/or allowing a hazardous condition" and failing to maintain or inspect the premises adequately. Furthermore, it accuses Hartzell of not correcting or warning about the danger despite being aware of it or having sufficient time to discover it through reasonable care. As a result of this alleged negligence, Nerenberg claims she sustained permanent injuries affecting her physical and mental well-being, including pain and suffering, disability, disfigurement, and loss of enjoyment of life.
Nerenberg is seeking compensatory damages exceeding $50,000 for her injuries and related expenses such as hospitalization and medical care. She demands judgment in her favor for incidental and consequential damages along with post-judgment interest and court costs. Additionally, she requests any other relief deemed appropriate by the court.
