Amy Jennings has taken legal action against a local welding and fabrication company, alleging that the business failed to fulfill its contractual obligations and unlawfully retained her deposit. On January 8, 2025, Jennings filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Mike’s Mobile Welding & Fabrication LLC, also known as Phoenix Fabrication.

The lawsuit stems from an agreement made on June 21, 2024, when Jennings contracted the defendant to design and install a custom aluminum gate at her property. She provided a refundable deposit of $20,966.11 with the expectation that shop drawings would be prepared for her approval before work commenced. However, according to Jennings' complaint, the defendant became unresponsive and failed to deliver the necessary drawings or commence work within a reasonable timeframe. Consequently, on July 16, 2024, Jennings demanded the return of her deposit but received no response despite multiple follow-up requests.

In addition to conversion claims where she accuses the defendant of wrongfully retaining her funds for their own use, Jennings also alleges embezzlement and unjust enrichment as alternative claims. The plaintiff asserts that Mike’s Mobile Welding & Fabrication LLC knowingly withheld her money with felonious intent in violation of Florida Statutes §812.014(1), constituting civil theft.

Jennings is seeking judgment for monetary damages including treble damages under Fla. Stat. §772.11 due to civil theft allegations amounting to $62,898.33 plus attorney fees and costs incurred during this legal pursuit. Her legal representation argues that all conditions precedent have been met or waived by the defendant.

Represented by Gregory R. Elder from Law Offices of Gregory R. Elder PLLC located in Boca Raton, Amy Jennings aims to recover her losses through this court filing identified as Case Number: 502025CA000171XXXAMB.
