In a recent legal filing, a Palm Beach County resident has taken legal action against a well-known furniture retailer, accusing them of negligence leading to personal injury. The complaint was filed by Tina Miller in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida on January 9, 2025, targeting City Furniture, Inc.
The lawsuit stems from an incident that occurred on June 22, 2024, when Miller visited the City Furniture store located at 10312 Forest Hill Blvd Unit 200 in Palm Beach County as a business invitee. According to the complaint, while on the premises, Miller tripped and fell due to a broken tile, which she claims was a result of the defendant's negligent maintenance of their property. The plaintiff argues that City Furniture failed to maintain safe conditions on their premises and neglected to warn patrons about potential hazards.
Miller’s complaint outlines several allegations against City Furniture. It accuses the company of "carelessly and negligently failing to maintain the grounds" and creating "a dangerous condition" that posed a hazard to patrons like herself. Furthermore, it alleges that City Furniture either knew or should have known about this hazardous condition through reasonable care but failed to address it or warn visitors adequately. As a consequence of these alleged negligent acts or omissions by City Furniture and its agents or servants, Miller claims she suffered significant injuries including bodily harm, pain and suffering, mental anguish, loss of earnings capacity among other damages.
In her lawsuit, Miller is seeking damages exceeding $50,000 but remains uncertain if they surpass $75,000. She demands judgment for damages against City Furniture along with costs associated with this action and any other equitable relief deemed appropriate by the court. Additionally, she requests a trial by jury for all issues triable as such.
