The plaintiffs allege negligence on two separate occasions at the defendant's premises.
The case centers around two incidents where Janice Brookmire claims to have suffered injuries due to unsafe conditions at The Polo Club of Boca Raton. According to the complaint, on May 5, 2023, Brookmire was an invitee at the club when she encountered an uneven walkway with loose tiles leading from the clubhouse to the pool area. This hazardous condition allegedly caused her to trip and fall. The lawsuit asserts that "Defendant negligently operated or maintained the premises by causing or allowing an unreasonably dangerous condition to exist." It further claims that this dangerous condition was either created by or known to the defendant and existed long enough for them to address it.
A second incident is cited in the complaint occurring on September 29, 2023. Brookmire again alleges negligence on part of The Polo Club of Boca Raton when she slipped at a recently resurfaced pool entry due to insufficient sand/grain making it unreasonably slippery. Similar accusations are made regarding the defendant's knowledge and maintenance of this hazard.
As a result of these incidents, Brookmire reports suffering "bodily injury and resulting pain and suffering," among other damages such as disability and mental anguish. Her husband, George Goldstein, is also listed as a plaintiff seeking damages for loss of consortium—claiming he has lost his wife's companionship and support due to her injuries.
The plaintiffs seek judgment for damages exceeding jurisdictional limits along with costs incurred due to these alleged negligent acts. They demand a jury trial for all issues so triable as a matter of right.
