Plaintiff alleges negligence against Florida-based restaurant after slip-and-fall incident

A slip and fall incident at a popular Florida establishment has led to a lawsuit that could cost the business over $50,000. Melanie Renko filed a complaint against Tin Roof Delray Beach, LLC in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida on December 19, 2024. The complaint accuses Tin Roof Delray Beach of negligence leading to severe injuries.

According to the court documents, Melanie Renko was visiting Tin Roof Delray Beach on November 4, 2023, when she tripped and fell on a black step at the premises located at 8 E Atlantic Ave, Delray Beach. Renko claims that the fall resulted from the defendant's failure to maintain a safe environment for its patrons. The lawsuit asserts that Tin Roof Delray Beach had a duty to ensure reasonably safe conditions for its business invitees but failed in several respects. "The Defendant owed to its business invitees a duty to provide a reasonably safe environment," states the complaint.

Renko's allegations include accusations that Tin Roof Delray Beach negligently failed to design, install, or adequately maintain their premises, thus creating an unreasonably dangerous condition. Furthermore, she claims that they did not inspect or adequately inspect the area where she fell to identify potential hazards. She also accuses them of failing to warn her about the dangerous condition of the entrance/landing area and not correcting it despite knowing—or having reason to know—of its hazardous nature.

As per Renko's complaint, this negligence resulted in severe injuries causing physical and mental pain and suffering, disability, disfigurement, mental anguish, inconvenience, loss of enjoyment of life, and permanent aggravation of pre-existing conditions. These injuries have led her to incur hospital bills and other medical expenses which are expected to continue into the future.

Renko is seeking damages exceeding $50,000 exclusive of interest and costs from Tin Roof Delray Beach. Her demands include compensation for her injuries as well as any additional relief deemed appropriate by the court. Additionally, she has requested a jury trial for all issues triable by right.
