In a heart-wrenching case that underscores the potential consequences of medical negligence, a couple has filed a lawsuit following the tragic death of their newborn son. Morgan Jacobs and Joshua Jacobs have taken legal action against multiple healthcare providers, including Nicole Baker, M.D., Women’s Care Florida, LLC, and others, alleging wrongful death due to medical malpractice. The complaint was filed on December 13, 2024, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida.

The plaintiffs, Morgan and Joshua Jacobs, are suing on behalf of their deceased son Flynn Jacobs' estate. They claim that negligence during prenatal care and delivery led to Flynn's untimely death on December 17, 2022—the very day he was born. According to the complaint, Morgan Jacobs presented at Morton Plant Hospital with signs of pre-term labor under the advisement of her obstetrician-gynecologist. Despite early indications that Flynn was unable to tolerate labor conditions—such as fetal heart rate decelerations—the defendants allegedly failed to take necessary precautions or timely actions.

The lawsuit accuses Dr. Nicole Baker and other involved medical professionals of failing to provide adequate care during labor and delivery. Specifically, it is alleged that Dr. Baker did not promptly respond to signs of fetal distress nor initiate an emergency cesarean section in time. The complaint further details how these delays contributed to Flynn suffering from severe oxygen deprivation leading to his death shortly after birth.

Morgan and Joshua Jacobs are seeking compensatory damages for mental anguish and loss of consortium due to their son's death. They argue that this tragedy could have been avoided had the defendants adhered to standard medical practices for managing high-risk deliveries. The plaintiffs demand judgment against all named defendants for damages exceeding $50,000 as well as any additional relief deemed appropriate by the court.
