Taylor Davis has filed a lawsuit against a major sporting goods retailer following an incident that left her daughter, Olivia Davis, injured. The complaint was lodged in the Sixth Judicial Circuit in Pinellas County, Florida on December 13, 2024, naming Dick's Sporting Goods, Inc. and its manager Jennifer Uhl as defendants.
The case revolves around an unfortunate event that occurred on October 19, 2024, at a Dick's Sporting Goods store located at 6775 22nd Ave N in St. Petersburg, Florida. According to the complaint filed by Taylor Davis as the guardian of her minor daughter Olivia Davis, the young girl was visiting the store when she was struck by a barbell that had been improperly secured. The barbell fell from its holder and hit Olivia above her right eye before landing on her chest, causing significant injuries.
The lawsuit accuses Dick's Sporting Goods of negligence for failing to maintain a safe environment for its customers. It alleges that the company breached its duty by allowing a hazardous condition to exist — specifically by not fastening or balancing the barbell properly. "The Defendant owed a non-delegable duty to maintain said premises in a reasonably safe condition," states the complaint. It further argues that this negligence led directly to Olivia's injuries which include bodily harm and resulting pain and suffering.
In addition to targeting the corporation itself, the lawsuit also holds Jennifer Uhl accountable both individually and in her capacity as manager of the store. The plaintiff claims that Uhl failed in her responsibilities to ensure safety protocols were followed and did not adequately inspect or warn about potential hazards like unsecured equipment displays. "Defendant Jennifer Uhl knew or should have known that the display in question was unsafe," reads one part of the filing.
As compensation for these alleged oversights and their consequences, Taylor Davis is seeking damages exceeding $50,000 from both defendants along with associated costs and interest. She demands judgment for these amounts citing various forms of relief including compensation for medical expenses incurred due to Olivia’s injuries as well as future losses stemming from ongoing impacts on quality of life.
