A harrowing case has emerged from Palm Beach County, Florida, involving allegations of neglect and violation of resident rights at a nursing home. The complaint was filed by Orita Mere on December 5, 2024, in the Circuit Court of the 15th Judicial Circuit against Terrace of Boca Raton, LLC, doing business as Menorah House.

The lawsuit details a troubling account of alleged negligence during Orita Mere's residency at Menorah House. According to the complaint, Mere suffered from an incision site infection that developed and deteriorated due to inadequate care. The plaintiff accuses the defendant of failing to develop an adequate care plan and properly monitor and supervise her treatment. These failures are claimed to be in direct violation of Florida Statute §400, which outlines the standards for operating nursing homes in the state.

Orita Mere's legal team argues that Menorah House had a non-delegable duty to ensure her rights as a nursing home resident were upheld. This includes providing appropriate healthcare services, preventing abuse, complying with health regulations, and treating residents with dignity. However, Mere alleges that these responsibilities were neglected through various acts or omissions by the facility's staff and management.

Specific accusations include failure to supervise Mere adequately, not developing proper care plans, insufficient record-keeping, lack of monitoring significant health changes like infection development, and failing to notify family or physicians about her deteriorating condition. Additionally, the complaint cites improper staff training and retention as contributing factors to the alleged neglect.

Mere seeks compensatory damages for physical injuries and emotional distress resulting from these alleged violations. She claims damages for loss of dignity, humiliation, pain and suffering, disability, disfigurement, mental anguish, inconvenience, medical expenses among others. The plaintiff is also demanding prejudgment interest and has requested a jury trial on all issues deemed triable by right.
