The incident in question occurred on December 17, 2023, when Kalvoda-Pyle visited the facility located at 1820 Shore Drive S., South Pasadena. She was there as an invitee of a resident and claims to have tripped over a raised portion of the entrance that was not visible to the naked eye. This fall resulted in significant injuries for Kalvoda-Pyle, prompting her to take legal action against the property owner. The plaintiff argues that Marlin Dolphin View Propco LLC failed in its duty of care by not maintaining the entrance area in a safe condition and neglecting to warn visitors about potential hazards.

Kalvoda-Pyle's lawsuit outlines several allegations against Marlin Dolphin View Propco LLC. She accuses them of negligence for failing to maintain or adequately inspect the walkway and for not providing warnings about the dangerous conditions present. The complaint states that these oversights led directly to her injuries, which include pain and suffering, disability, disfigurement, mental anguish, and other damages. According to Kalvoda-Pyle's legal team, these damages are both permanent and ongoing.

The plaintiff is seeking damages exceeding $50,000 from Marlin Dolphin View Propco LLC. Her attorney has emphasized that this amount is exclusive of costs, interest, and attorney fees. Kalvoda-Pyle demands a trial by jury to determine fair compensation for her injuries and losses.
