Plaintiff (property owner) sues Defendant (tenant) over breach of lease agreement

Pinellas Five, LLC has taken legal action against GD4 Test Services, Inc., alleging breach of a lease agreement. The complaint was filed by Pinellas Five, LLC in the Circuit Court of the Sixth Judicial Circuit of Florida in Pinellas County on October 30, 2024. The defendant in this case is GD4 Test Services, Inc., a Texas corporation.

The lawsuit centers around a property located at 12505 Starkey Road, Suite N, Largo, FL 33773, which was leased to GD4 Test Services by Pinellas Five under an Amended and Restated Lease Agreement dated September 8, 2022. According to the plaintiff, the lease commenced on December 1, 2022, and was set to expire on November 30, 2027. However, due to alleged nonpayment of rent by GD4 Test Services, a Final Default Judgment of Eviction was entered on June 28, 2024. This judgment allowed Pinellas Five to regain possession of the property.

Pinellas Five claims that GD4 Test Services defaulted under the lease for failing to pay rent as stipulated in the agreement. As per the terms outlined in the lease's Schedule of Terms, GD4 Test Services owed past-due rent amounting to $43,374.71 as of June 2024. Furthermore, Pinellas Five has chosen to accelerate the remaining unpaid rent payments for the entire term of the lease from August 1, 2024 through November 30, 2027. This accelerated rent amounts to $320,992.96.

In addition to unpaid and accelerated rent payments totaling $370,567.67 (referred to as "Total Damages"), Pinellas Five alleges that GD4 Test Services abandoned personal property and caused damage requiring $6,200 in removal and repair costs upon vacating the premises. The plaintiff argues that these actions constitute a material breach of the lease agreement and seeks recovery for all associated damages.

Pinellas Five is seeking monetary damages exceeding $50,000 from GD4 Test Services for breach of contract. They are also requesting reimbursement for attorneys' fees and court costs incurred during this legal process as well as pre- and post-judgment interest.
