Miriam Del Carmen Alvarez has filed a lawsuit against a local supermarket, claiming negligence led to her sustaining serious injuries. The complaint was lodged on October 23, 2024, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, naming M3 5851 Corp., doing business as Jumbo Supermarket, as the defendant.

The incident at the heart of this case occurred on June 4, 2022. Alvarez was shopping at Jumbo Supermarket located at 5851 Lake Worth Road in Greenacres, Florida. While approaching the cash register, she suffered a laceration to her hand caused by a sharp cashier shield placed on the register counter. According to Alvarez's complaint, this injury resulted in "serious personal injuries," which have had lasting effects on her health and quality of life.

Alvarez alleges that the supermarket failed in its duty to maintain safe premises for its customers. The complaint outlines that Jumbo Supermarket had an obligation to ensure their premises were free from hazards and to warn customers of any concealed dangers that could not be easily discovered by patrons exercising due care. The plaintiff argues that the supermarket breached this duty by allowing an unreasonably sharp shield to remain in place without warning customers of its potential danger.

The lawsuit claims that the dangerous condition existed for a sufficient length of time or occurred with such regularity that Jumbo Supermarket should have been aware of it through ordinary care. As a result of this alleged negligence, Alvarez states she has endured pain and suffering, disability, disfigurement, mental anguish, and incurred expenses related to medical treatment and loss of earnings both past and future. These damages are described as permanent and continuing.

In her lawsuit, Alvarez is seeking judgment for damages exceeding $50,000 plus costs and interest against M3 5851 Corp., along with any other relief deemed appropriate by the court. She also demands a jury trial for all issues so triable as a matter of right.

Representing Miriam Del Carmen Alvarez is Irwin Ast from Irwin Ast P.A., based in Miami, Florida. The attorneys listed include Irwin Ast and Leidy Cuervo. The case is being handled under Case Number: 502024CA010171XXXAMB Div: AK.
