A medical malpractice lawsuit has been filed, alleging negligence during a surgical procedure that resulted in significant harm to the patient. On October 15, 2024, Lee Cubbedge initiated legal action in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Dr. Leroy Charles, his professional association, and Wellington Regional Medical Center.
The complaint centers around a surgery performed on March 10, 2022, where Mrs. Cubbedge was scheduled for a laparoscopic hysterectomy and left salpingo-oophorectomy at Wellington Regional Medical Center. During the procedure, Dr. Charles mistakenly removed her right ovary instead of the left one despite determining that the left ovary was benign. The pathology report later confirmed no malignancies in the removed right ovary. This error led to continued pain for Mrs. Cubbedge and necessitated another surgery on March 27, 2024.
Mrs. Cubbedge's complaint asserts that both Dr. Charles and Wellington Regional Medical Center failed to meet acceptable standards of care. Specifically, she accuses Dr. Charles of negligence for not performing the necessary surgery correctly and failing to obtain consent before altering the surgical plan from a laparoscopic to a vaginal hysterectomy mid-procedure without proper documentation or explanation.
Furthermore, Mrs. Cubbedge claims that Wellington Regional Medical Center's nursing staff did not intervene appropriately during the surgery to prevent this mistake or advocate on her behalf when it became clear that an error was occurring.
The plaintiff seeks damages exceeding $50,000 for permanent injury, disfigurement, mental anguish, loss of enjoyment of life, pain and suffering, lost income, future loss of earning capacity, and incurred medical expenses—all consequences she attributes to this alleged negligence.
