A legal battle is unfolding in Palm Beach County, Florida, where a local resident has filed a lawsuit against both a security company and the county's Board of Commissioners. The complaint was lodged by Gwendy Blumberg on October 9, 2024, targeting Professional Security Consultants, Inc., and the Board of County Commissioners of Palm Beach County.

The lawsuit stems from an incident that occurred on January 29, 2021, at the Lake Worth Department of Motor Vehicles. Blumberg claims she was injured due to negligence on the part of both defendants. According to the complaint, while visiting the DMV as a business invitee, Blumberg tripped over an inadequately marked ADA curb ramp and fell. A security guard employed by Professional Security Consultants allegedly exacerbated her injuries by handling her roughly when attempting to assist her after the fall. The plaintiff asserts that these actions resulted in "permanent and significant injuries" to her body.

Blumberg accuses the Board of County Commissioners of failing to maintain safe premises and not warning visitors about potential hazards. She argues that the board had a "non-delegable duty" to ensure safety for business invitees like herself. The complaint lists several alleged failures by the board, including allowing hazardous conditions to exist and failing to inspect or correct them adequately.

In addition to holding the county accountable, Blumberg also targets Professional Security Consultants for their role in providing security services at the DMV on the day of her accident. She claims that their negligence directly contributed to her injuries and seeks damages for pain and suffering, medical expenses, loss of earnings, and other related costs.

Blumberg is seeking compensatory damages exceeding $50,000 from both defendants. Her demands include compensation for physical and mental suffering, disability, disfigurement, loss of enjoyment of life, medical expenses, lost wages both past and future, as well as attorney fees and court costs.

Representing Gwendy Blumberg are attorneys Jarret S. McNeill and Jose E. Aguirre from Lowercase PLLC based in Miami. The case is filed under Case Number 502024CA009691.
