Andrea Chauncey-Horsky initiated the complaint on October 3, 2024, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Rolando Alvarez, MD, PharmX Universal LLC doing business as PharmX HealthOne, and Cleveland Clinic Florida.
The plaintiff, Andrea Chauncey-Horsky, claims that she suffered permanent injuries due to the negligent medical care provided by the defendants. According to the lawsuit, Chauncey-Horsky first sought treatment from Cleveland Clinic Florida's endocrinology department on July 8, 2022. She was experiencing hyperthyroidism and unintentional weight loss. Despite her symptoms and risk factors such as smoking and a family history of stroke, the clinic allegedly prescribed Megace—a drug typically used for advanced cancer patients or those with AIDS—without adequately informing her of its risks. The complaint states that this off-label use carried an increased risk of stroke.
On October 27, 2022, Chauncey-Horsky began receiving care from Dr. Rolando Alvarez at PharmX HealthOne. The lawsuit accuses Dr. Alvarez of prescribing hormone replacement therapy without proper examination or consideration of potential interactions with Megace. Furthermore, it is alleged that neither Dr. Alvarez nor Cleveland Clinic adequately monitored her condition or informed her about the associated risks.
Tragically, on January 30, 2023, Chauncey-Horsky suffered an ischemic stroke resulting in permanent damage despite emergency medical intervention. The plaintiff argues that this outcome was a direct result of the negligent actions and omissions by both Cleveland Clinic Florida and Dr. Alvarez at PharmX HealthOne.
Chauncey-Horsky is seeking damages exceeding $50,000 for physical pain and suffering, mental anguish, disability, disfigurement, loss of enjoyment of life, medical expenses past and future including rehabilitation costs and loss of income capacity due to her condition's permanence. The lawsuit demands a jury trial to address these grievances.
