The complaint was filed by Elvita Cazeau in the Circuit Court of the Fifteenth Judicial Circuit of Florida, Palm Beach County, on October 2, 2024, against Presidente Supermarket No. 40, Inc.
According to the lawsuit, Elvita Cazeau claims that she sustained bodily injuries on September 2, 2023, while shopping at Presidente Supermarket located at 1565 S Congress Ave Bay #2 in Delray Beach. The plaintiff alleges that she slipped and fell due to an unknown substance on the floor of the store. The complaint asserts that Presidente Supermarket failed in its duty to maintain a safe environment for its patrons. Specifically, it accuses the supermarket of neglecting to ensure that floors were dry and free from hazardous substances and failing to adequately train employees to clean and inspect these areas regularly.
The complaint further details how Cazeau suffered from pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, and aggravation of a pre-existing condition as a result of the incident. It emphasizes that these damages are either permanent or ongoing in nature. In her filing, Cazeau is seeking damages exceeding $50,000 exclusive of costs and interest.
