Customer Sues Walmart Over Slip-and-Fall Incident

A slip-and-fall incident at a Florida Walmart has led to a lawsuit seeking damages in excess of $50,000. Jane Bacon filed the complaint against Walmart Inc., doing business as Walmart Supercenter #1134, in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, on September 19, 2024.

According to the court documents, Jane Bacon alleges that she was shopping at Walmart Supercenter #1134 located at 1226 US-331, Defuniak Springs, FL when she encountered a foreign transient substance on the floor. This caused her to fall and sustain injuries. The incident occurred on May 25, 2024. Bacon's complaint states that Walmart had a non-delegable duty to maintain its premises in a reasonably safe condition and failed to do so. The plaintiff argues that Walmart's negligence included failing to inspect or adequately inspect the premises for hazardous conditions, creating or allowing such conditions to exist, and not warning customers about these dangers.

The lawsuit outlines several specific allegations against Walmart. These include negligently failing to maintain the walkway/aisle where Bacon fell by allowing a foreign substance to be present and failing to correct or warn about this hazardous condition despite knowing—or reasonably being expected to know—about it. As a result of these alleged failures, Bacon claims she suffered permanent bodily injury, pain and suffering (both physical and mental), disability, physical impairment, disfigurement, mental anguish, inconvenience, loss of capacity for enjoyment of life, and incurred expenses related to hospitalization and medical treatment.

Bacon is seeking compensatory damages from Walmart for these injuries. She demands judgment in her favor for an amount exceeding the minimum jurisdictional limits of the court. This includes incidental and consequential damages as well as post-judgment interest and costs. The plaintiff is represented by Ms. E. Lynn Gibbons from Gibbons & Gibbons law firm based in St. Petersburg, Florida.

The case has been assigned Case Number 24-004227-ClI with Judge Ken Burke presiding over it.
