A couple has filed a lawsuit against a major grocery store chain, alleging negligence after a slip-and-fall incident left one of them injured. On September 10, 2024, Shirley A. Logan and her husband James Logan filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Publix Super Markets, Inc.
According to the complaint, on June 29, 2023, Shirley Logan was shopping at Publix Store #821 located at 4075 N Haverhill Rd in West Palm Beach when she slipped on water near the checkout lanes. The plaintiffs allege that there were no warning signs indicating the presence of water on the floor and that Publix failed to maintain or inspect the premises properly. The complaint states that this negligence led to Shirley Logan's fall and subsequent injuries.
The Logans claim that Publix either knew or should have known about the dangerous condition due to its extended existence or because of their failure to conduct regular inspections. They argue that Publix's lack of proper maintenance policies or enforcement thereof created a hazardous environment for customers. As a result of her fall, Shirley Logan reportedly suffered from bodily injury, pain and suffering, disability, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings, and aggravation of pre-existing conditions.
In addition to seeking damages exceeding $50,000 for Shirley Logan's injuries and associated costs, James Logan is also pursuing compensation for loss of consortium. He claims that his wife's injuries have deprived him of her comfort and companionship and have resulted in additional medical expenses for her care.
