A Palm Beach County woman has filed a lawsuit against a well-known fast-food chain, alleging negligence that led to her severe injuries. Wanda E. Timley lodged the complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on September 13, 2024, accusing Chick-fil-A, Inc. of failing to maintain safe premises.
According to the court documents, the incident occurred on December 28, 2022, at a Chick-fil-A location on Northlake Blvd in Lake Park, Palm Beach County. Timley was lawfully on the premises as a customer when she slipped and fell due to a wet and slippery substance on the floor. The complaint alleges that there were no warning signs indicating the hazardous condition. "The fall was caused as a result of the Defendant’s improper, non-existent or negligent maintenance and/or inspection and/or policy and/or care of said premises," states the document.
Timley claims that Chick-fil-A either knew or should have known about the dangerous condition but failed to take appropriate action to remedy it or warn customers. The complaint further asserts that Chick-fil-A did not properly inspect their premises or enforce policies to prevent such hazards. As a result of this alleged negligence, Timley suffered significant injuries including bodily harm, pain and suffering, mental anguish, loss of earnings capacity, and medical expenses.
The plaintiff is seeking damages exceeding $50,000 for her injuries and associated losses. She is also asking for additional relief including costs incurred due to hospitalization and ongoing medical treatment.
