Plaintiff Alleges Negligence Led To Elderly Mother's Death In Assisted Living Facility

A tragic case of alleged negligence and elder abuse has been brought to light in Palm Beach County, Florida. Cori Yarckin, as the Personal Representative of the Estate of Sylvia Yarckin, filed a complaint on September 13, 2024, against Boynton Beach Healthcare Services, LLC, doing business as Courtyard Gardens Senior Living, and its President and Owner Gregory J. Gozzo.

The complaint was filed in the Circuit Court of the 15th Judicial Circuit in Palm Beach County. It accuses Boynton Beach Healthcare Services and Gregory J. Gozzo of gross negligence that led to the suffering and eventual death of Sylvia Yarckin on April 10, 2024. According to the filing, Sylvia Yarckin was an elderly resident at Courtyard Gardens Senior Living who required heightened nursing care due to her health condition. Despite this need for specialized care, she was admitted into the facility without proper evaluation or supervision.

The plaintiff alleges that during her stay at Courtyard Gardens Senior Living, Sylvia Yarckin suffered multiple falls and unexplained injuries due to inadequate care and monitoring by the staff. The complaint details various failures by the defendants including not developing an adequate care plan for Sylvia Yarckin, insufficient staffing levels, lack of proper training for staff members, and failure to follow physician orders. These failures are claimed to be in direct violation of Florida Statute §429 which sets standards for operating assisted living facilities.

Cori Yarckin contends that these violations deprived Sylvia Yarckin of her rights as a resident under Florida law. "Defendant’s responsibilities to SYLVIA YARCKIN as outlined in Florida Statutes §429.28 are non-delegable," states the complaint. The plaintiff further argues that Gregory J. Gozzo's negligence constitutes tortious conduct not shielded from liability under existing legal precedents.

In seeking justice for Sylvia Yarckin's untimely death and suffering, Cori Yarckin is demanding compensatory damages exceeding $50,000 along with prejudgment interest and a jury trial on all triable issues. The lawsuit also leaves open the possibility of amending the complaint to include punitive damages at a later date.
