Homeowner Sues Condominium Association and Roofing Company Over Water Damage

A homeowner is taking legal action against a condominium association and a roofing company, alleging severe property damage due to negligence and breach of contract. Peter Boreyko filed the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on September 13, 2024, naming Five Towns of St. Petersburg, No. 304, Inc., and Avery's Bricks N Sticks Construction, Inc., doing business as Right Way Roofing, as defendants.

According to the complaint, Boreyko owns a condominium unit at 5521 80th St. N, Unit 506 in St. Petersburg, Florida. The plaintiff claims that Five Towns of St. Petersburg is responsible for maintaining common elements within the complex but failed to do so adequately. Boreyko asserts that both the association and Right Way Roofing entered into a contract to replace and repair roofs throughout the complex, including his unit's roof. On July 15, 2024, water intrusion allegedly caused significant water and mold damage to Boreyko's property due to improper roofing installation by Right Way Roofing.

The lawsuit accuses Right Way Roofing of failing to use due care while performing roofing services and refusing to remedy or repair the damages caused by their work. The complaint also alleges that Five Towns of St. Petersburg neglected its duty to maintain common elements like the roofing and gutter systems properly. This failure led directly to water intrusion and subsequent damage within Boreyko's unit.

Boreyko is seeking various forms of relief from the court: compensation for all damages incurred—including damage to personal property and loss of use—pre-judgment interest, court costs, expert fees, attorneys' fees under Florida Statute §718.303, and any other relief deemed just by the court.

The case is being handled by attorneys D. Scott Boggs and John Taylor Tetterton from Boggs Law Group P.A., with Judge Ken Burke presiding over Case Number 24-004120-CI.
