A man is suing a Florida town after slipping on a marina ramp, claiming negligence. Michael Volcan filed the complaint against the Town of Lake Park in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on September 3, 2024.
According to the lawsuit, on April 27, 2023, Michael Volcan was walking on a floating boat ramp at Lake Park Marina when he slipped and fell due to the absence of anti-slip strips. The fall resulted in severe and permanent injuries. Volcan asserts that the Town of Lake Park failed to maintain the boat ramp properly and neglected their duty to ensure it was safe for public use. The plaintiff argues that this oversight constitutes negligence under Florida law.
The complaint details several allegations against the Town of Lake Park, including failure to maintain, inspect, and clean the boat ramp; allowing a slip hazard to persist; not installing anti-slip strips; and failing to warn users about the dangerous condition. "Defendant knew or should have known that the premises were not in a reasonably safe condition," states Volcan's filing. As a result of these alleged failures, Volcan suffered grievous bodily injury, pain and suffering, mental anguish, medical expenses, lost wages, and loss of future earning capacity.
Volcan is seeking damages exceeding $50,000 for his injuries. He demands judgment for damages against the Town of Lake Park for court costs, interest, and any other relief deemed appropriate by the court. The case underscores his claim that these losses are permanent and will continue into the future.
