A Palm Beach County resident has filed a lawsuit against a major storage company, alleging negligence and seeking damages for injuries sustained on the company's premises. Tandra Maffett filed the complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on September 3, 2024, against Public Storage, Inc.
According to the complaint, Maffett was an express or implied business invitee at Public Storage's facility located at 7480 S Military Trail in Lake Worth, Florida, on April 5, 2023. The plaintiff claims that while on the premises, she encountered a slippery substance on the walkway caused by leakage from pipes or other fixtures. This hazardous condition allegedly led to her falling and sustaining serious injuries. The lawsuit asserts that Public Storage had a duty to maintain its premises in a reasonably safe condition but failed to do so.
The complaint details multiple ways in which Public Storage allegedly breached its duty of care. It states that the company did not use reasonable care to maintain safe conditions, failed to correct known dangerous conditions, and did not warn Maffett of latent dangers. Specifically, it accuses Public Storage of failing to inspect and repair leaking pipes and drainage systems adequately. "Defendant must take reasonable precautions and measures to prevent such dangers or make them safe or warn of them," reads one part of the complaint.
Maffett is seeking judgment for all allowable damages under Florida law against Public Storage. She demands compensation exceeding the jurisdictional limits of the court for medical expenses, pain and suffering, loss of earnings, and other related costs. Additionally, she requests prejudgment interest where applicable and coverage for legal costs incurred during this action.
The case is being handled by E. Paul Dozois Esq., from Felice Trial Attorneys based in West Palm Beach. The presiding judge is yet to be named. The case identification number is 502024CA008365XXXAMB Div: AD.
