Pinellas County Resident Sues Local Medical Spa Over Severe Laser Burns

A resident of Pinellas County, Florida, has filed a lawsuit alleging severe negligence by a local medical spa and its employees. On September 4, 2024, Marie Torres filed a complaint in the Circuit Court of the 6th Judicial Circuit in and for Pinellas County against George Kamajian, D.O., Cassandra Beals, Dr. K’s Med Spa LLC, and RAD & More LLC.

According to the complaint, Torres underwent a laser hair removal treatment on October 31, 2022, at Dr. K’s Med Spa or RAD & More's Largo Clinic. The procedure was performed by Cassandra Beals, an esthetician employed by the defendants. During this treatment, Torres suffered severe laser burns resulting in permanent scarring, discoloration, and disfigurement. The plaintiff alleges that Beals failed to establish safe parameters for the treatment and did not perform necessary test spots to ensure safety. "Failure to properly use and/or adjust the wavelength and/or Fluence settings when treating Plaintiff," reads one of the accusations against Beals.

The complaint also holds George Kamajian accountable as he was the medical director responsible for overseeing and supervising all employed physicians and staff at both Dr. K’s Med Spa and RAD & More during the time of Torres' treatment. The plaintiff asserts that Kamajian failed to exercise proper care in supervising Beals' actions which directly led to her injuries.

Torres claims that both Dr. K’s Med Spa LLC and RAD & More LLC are vicariously liable for Beals' negligent actions since she was acting within her scope of employment during the incident. Additionally, Torres argues that these entities breached their non-delegable duty to provide non-negligent care as agreed upon in their contract with her.

Marie Torres is seeking damages exceeding $50,000 for physical pain, emotional distress, medical expenses incurred due to her injuries, permanent loss of bodily function, scarring, disfigurement, and diminished capacity for enjoyment of life. She demands a jury trial on all issues triable by right.
