A resident of Largo, Florida, has filed a lawsuit against multiple entities for negligence after suffering significant injuries from tripping over an electrical junction box. On September 6, 2024, Donald Turner lodged the complaint in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, targeting Imperial Palms Apartments Limited Partnership, The Goodman Group, LLC, and Falcon Electric, Inc.
According to the complaint, Turner was a tenant at Imperial Palms Apartments on March 20, 2023. He alleges that while walking through a common area of the apartment complex located at 101 Imperial Palm Dr., Largo, he tripped over an improperly maintained electrical junction box and sustained severe injuries. Turner asserts that Imperial Palms Apartments owned the property and The Goodman Group managed it. Falcon Electric had a service agreement to perform electrical services in the common areas of the complex.
Turner’s lawsuit accuses all three defendants of failing to uphold their duty of care. He claims that Imperial Palms Apartments neglected to maintain safe premises and failed to warn residents about hazardous conditions. "Defendant breached those duties by negligently failing to maintain or adequately maintain the electrical junction box," reads one part of the complaint. Similarly, The Goodman Group is accused of not inspecting or warning about dangerous conditions despite being aware or should have been aware of them through reasonable care.
The allegations against Falcon Electric focus on their purported failure to properly service and secure the electrical junction box. Turner contends that this negligence created an unreasonably dangerous condition likely to cause injury to tenants like himself.
Turner is seeking damages exceeding $50,000 for his pain and suffering, medical expenses, loss of earnings, and other economic damages resulting from his injuries. He also demands a jury trial for all triable issues.
