Hotel Guest Sues Hilton West Palm Beach Over Slip-and-Fall Incident

A Tennessee resident has filed a lawsuit against a prominent hotel in West Palm Beach, Florida, seeking damages for injuries sustained in a slip-and-fall incident. Kenneth Harris filed the complaint on August 15, 2024, in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, against CityPlace Hotel, LLC, doing business as Hilton West Palm Beach.

According to the complaint, Harris was lawfully on the premises of Hilton West Palm Beach on October 13, 2023, when he slipped and fell due to a hazardous condition. The plaintiff alleges that the hotel failed to maintain its premises in a safe condition and neglected to warn him of potential dangers. "At all times material hereto," states the complaint, "Defendant HILTON owed a non-delegable duty to customers...to inspect and maintain the premises...in a reasonably safe condition." Harris claims that his fall resulted from the hotel's negligence in allowing a slippery substance or object to remain on the floor.

The lawsuit outlines several specific allegations against Hilton West Palm Beach. These include failing to inspect or adequately inspect the floor where Harris fell, not detecting or correcting the hazardous condition despite knowing about it or having reasonable grounds to know about it, and failing to provide adequate warnings about the dangerous condition. The plaintiff asserts that these failures constitute breaches of duty that directly led to his injuries.

Harris's injuries are described as severe and permanent. He is seeking compensatory damages exceeding $50,000 for various harms including permanent injury, disability, disfigurement, pain and suffering, mental anguish, loss of enjoyment of life, lost wages both past and future, and medical expenses incurred due to his injuries. The complaint also mentions that Harris will require future medical treatment and will incur additional damages as a result.

The case is being handled by attorneys Eric S. Rosen and Elaine D. Loibman from Rosen Injury Law based in Davie, Florida. The presiding judge is yet to be named under Case Number 502024CA007738XXXAMB Div: AG.
