Plaintiff Alleges Negligence Against Walmart Following Slip-and-Fall Incident

A slip-and-fall incident at a Walmart store has led to a lawsuit seeking over $50,000 in damages. Bibi Hussain filed the complaint against Walmart Stores East, LP in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida on August 14, 2024.

According to the complaint, Hussain was shopping at the Walmart West Palm Beach Supercenter on May 18, 2024, when she slipped and fell on dirty water that had pooled on the floor due to a leak from the fridge area. The plaintiff alleges that this hazardous condition was due to Walmart's negligence in maintaining their premises. "The injuries resulting from this fall were solely and wholly as a result of the negligent manner that the Defendant, its agents, servants and/or employees owned, operated, maintained, managed, and controlled the aforesaid premises," states the complaint.

Hussain claims that Walmart failed to uphold its duty of care by not addressing or warning about the dangerous condition. Specific accusations include allowing dirty water to pool on the floor, failing to detect or remove it despite knowing or reasonably being expected to know about it, and not providing adequate warnings to customers. Additionally, Hussain argues that Walmart failed in several other ways: improper flooring surfaces that became slippery when wet; failure to follow store safety policies; and inadequate supervision and training of employees.

As a result of this alleged negligence, Hussain asserts she suffered serious and permanent bodily injuries leading to pain and suffering, mental anguish, medical expenses, loss of enjoyment of life, and disfigurement. These injuries are described as either permanent or continuing in nature.

Hussain is seeking judgment against Walmart for an amount exceeding $50,000 plus interest and costs. She also demands a jury trial for all issues triable by right.
