Local Resident Sues Burger King Franchise Over Slip-and-Fall Incident

A local resident has filed a lawsuit against several companies, including a well-known fast-food chain, following an alleged slip-and-fall incident. Alexis J. Gilbert filed the complaint in the Circuit Court of the 6th Judicial Circuit in and for Pinellas County, Florida on August 15, 2024, naming ARC CAFEHLD001 LLC, BRAVOTAMPA, LLC #4101, BRAVOTAMPA, LLC D/B/A BURGER KING, and BURGER KING COMPANY LLC as defendants.

According to the complaint, on November 28, 2023, Gilbert was a customer at a property located at or near 13238 66th St. N in Largo, Florida. The plaintiff alleges that while walking on the premises managed by ARC CAFEHLD001 LLC and other defendants, she slipped and fell due to a slippery substance on the floor. Gilbert claims that this incident resulted in injuries to her body and extremities which required medical treatment and led to physical handicap and impaired working ability.

The lawsuit details several counts of negligence against each defendant. For instance, it accuses ARC CAFEHLD001 LLC of failing to maintain the floor properly, not conducting adequate inspections to ensure no hazardous conditions existed, failing to warn customers about the slippery floor, and not removing foreign substances from the floor. Similar allegations are made against BRAVOTAMPA entities and Burger King Company LLC.

Gilbert's attorney argues that these failures constitute breaches of duty of care owed to her as a customer lawfully on the property. The complaint states that these dangerous conditions were either known or should have been known by the defendants due to their regular occurrence or prolonged existence.

As relief from the court, Gilbert seeks compensatory damages exceeding $50,000 exclusive of attorney's fees and costs. She also demands any taxable costs associated with bringing forth this lawsuit along with other relief deemed just by the court.
