Shopper Sues Retail Giant Over Slip-and-Fall Incident

A serious slip-and-fall incident at a retail giant's store has led to a legal battle in Pinellas County, Florida. On August 8, 2024, Anthony Chirico filed a complaint against Wal-Mart Stores East, LP in the Circuit Court of the Sixth Judicial Circuit. The case alleges negligence on the part of Wal-Mart that resulted in Chirico suffering significant injuries.

According to the complaint, on October 3, 2023, Anthony Chirico visited a Wal-Mart store located at 41232 US Highway 19 N., Tarpon Springs, FL for shopping purposes. During his visit, Chirico slipped on what is described as a "transitory foreign substance" on the floor of the store. This incident led to severe injuries including bodily harm, pain and suffering, disability, disfigurement, mental anguish, and loss of capacity for enjoyment of life. Furthermore, Chirico claims he incurred expenses related to hospitalization and medical care and experienced loss of earnings and earning capacity.

The plaintiff argues that Wal-Mart had a duty to maintain its premises in a reasonably safe condition and to warn customers about any dangerous conditions. The complaint outlines several breaches of this duty by Wal-Mart: failing to maintain the premises safely, failing to warn about unsafe conditions, and failing to monitor for such conditions. Additionally, it asserts that Wal-Mart either knew or should have known about the hazardous condition due to its regular occurrence or because it existed long enough for the company to take action.

Chirico's attorneys from Farah & Farah P.A., Savannah L. Cooley and John Marcus argue that these failures constitute negligence under Florida law. They contend that as a direct result of this negligence, Chirico has sustained permanent injuries with ongoing consequences.

In terms of relief sought from the court, Chirico demands judgment for damages exceeding $50,001 exclusive of costs and attorney’s fees. He also requests a trial by jury for all triable issues related to this case.
