A Northbrook, Illinois resident has filed a lawsuit against a prominent hotel chain following a severe injury sustained on their property. Thomas Scott Kempner lodged the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on August 8, 2024, targeting Park Hotels & Resort, Inc., formerly known as Hilton Worldwide, Inc.

The case centers around an incident that occurred on August 18, 2022. Kempner was walking through the lobby of the Hilton West Palm Beach when he slipped on water that had leaked from a dispenser. The plaintiff claims there were no warning signs or mats to indicate the hazardous condition. As a result of the fall, Kempner alleges he suffered permanent injuries and significant damages.

Kempner's complaint accuses Park Hotels & Resort of negligence. The lawsuit details several ways in which the hotel allegedly failed to maintain safe premises. According to Kempner, the hotel did not properly manage or warn guests about potential hazards like water spills. "The Defendant knew, or should have known," reads the complaint, "and could foresee and anticipate that guests such as the Plaintiff would be utilizing the lobby walkway." The document further states that liquid substances frequently got onto the floor, putting Park Hotels & Resort on constructive notice of a dangerous condition.

The plaintiff is seeking damages exceeding $50,000 for bodily injury, pain and suffering, disability, disfigurement, mental anguish, medical expenses, and loss of enjoyment of life. Additionally, Kempner demands a jury trial to resolve his claims against Park Hotels & Resort.

Representing Thomas Scott Kempner is Caroline Lapiec from Romano Law Group based in West Palm Beach.

The Case Number is 502024CA007483XXXAMB Div: AH.
