Nursing Home Accused of Negligence Leading to Severe Injuries

A nursing home in Jupiter, Florida is facing serious allegations of negligence and inadequate care. On August 2, 2024, Rachel Hooker filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County against Nuvista Living at Jupiter LLC, operating as Luxe Rehabilitation Center at Jupiter.

The plaintiff, Rachel Hooker, acting as the next friend of her mother Sharon Adams, accuses Nuvista Living at Jupiter LLC of failing to provide adequate care and protection for Adams during her residency at the facility. According to the complaint, Adams was transferred to Luxe Rehabilitation Center on April 24, 2023, after undergoing surgery for a left hip periprosthetic fracture. Despite being noted as cognitively intact but dependent on assistance for mobility and toileting, Adams allegedly did not receive necessary medication or proper care during her stay.

Hooker claims that due to the negligence of Nuvista Living at Jupiter LLC, Adams developed a surgical site infection because she was not given prescribed antibiotics. Furthermore, on May 1, 2023, Adams fell out of bed and sustained severe injuries including a new displaced fracture involving her left femur. The complaint states that the facility delayed notifying Hooker about the fall and calling emergency services despite Adams' evident pain.

The lawsuit outlines multiple breaches of duty by Nuvista Living at Jupiter LLC. These include failure to implement appropriate fall prevention measures such as bed rails or floor mats; failure to document the fall properly; neglecting to perform neurological checks post-fall; delaying emergency response; failing to change surgical dressings regularly; and not ordering essential medications timely. The plaintiff argues that these failures resulted in significant permanent bodily injuries for Adams, leading to disability and disfigurement.

As part of the legal action, Hooker seeks damages exceeding $50,000 exclusive of attorneys’ fees and costs. She demands judgment against Nuvista Living at Jupiter LLC for medical expenses incurred due to their alleged negligence and for future costs related to ongoing care needs stemming from Adams' injuries.
