Plaintiff Alleges Negligence Against Landlord Over Mold Infestation

A Pinellas County resident has filed a lawsuit against her landlord, alleging severe negligence that led to significant health issues and property damage. Rebecca Evans lodged the complaint in the Circuit Court of the Sixth Judicial County in Pinellas County, Florida, on July 29, 2024, targeting Largo Dental Building LLC for failing to maintain her workplace adequately.

The case revolves around claims of water intrusion and microbial contamination at Evans' workplace managed by Largo Dental Building LLC. According to the complaint, Evans began noticing mold within the premises as early as February 2024. Despite repeated notifications to the defendant about these hazardous conditions, no adequate remediation was performed. The plaintiff asserts that the defendant's negligent maintenance resulted in elevated moisture levels and harmful microbial growth, including fungi, molds, and bacteria.

Evans' lawsuit details how this neglect led to adverse health effects due to prolonged exposure to toxic mold. "Plaintiff suffered and likely will continue to suffer adverse health consequences after harmful contact with microbes," reads one part of the filing. The plaintiff claims that these conditions were exacerbated by Largo Dental Building LLC's failure to perform timely repairs or professional remediation.

The lawsuit outlines various breaches of duty by Largo Dental Building LLC. These include allowing moisture accumulation in structural elements, failing to hire competent mold assessors and remediators, and not warning Evans about the unsafe conditions. As a result of these breaches, Evans alleges she has suffered permanent personal injuries affecting her nervous system, pulmonary system, and immune system. She is seeking compensation for medical expenses, lost wages, pain and suffering, physical limitations, decreased enjoyment of life, and other related damages.

Evans is asking for a judgment exceeding $50,000 exclusive of attorney’s fees and costs. She also demands that Largo Dental Building LLC be held accountable for their gross negligence and seeks both compensatory damages for her injuries and punitive damages for their reckless disregard for safety.
