A routine visit to a local sports bar turned into a nightmare for one Palm Beach County resident, leading to a legal battle over alleged negligence. On July 24, 2024, Shavonne Dean filed a complaint in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, against Castaway’s Sports Bar & Grill II, LLC.
According to the complaint, Dean was at Castaway’s Sports Bar & Grill II on August 19, 2023, when she slipped and fell on an unidentified substance on the floor. The incident occurred at the establishment located at 2415 North Ocean Ave, Riviera Beach. Dean asserts that she was lawfully present as a business invitee when the accident happened.
The plaintiff's allegations center around claims of negligence by Castaway’s Sports Bar & Grill II. Dean contends that the defendant failed to maintain its premises in a reasonably safe condition and neglected to warn patrons of potential hazards. "Defendant owed to its business invitees a duty to maintain their premises in a reasonably safe condition and a duty to give warnings of dangerous conditions," states the complaint.
Dean accuses Castaway’s Sports Bar & Grill II of several specific acts of negligence: failing to keep the property inside the premises safe, allowing a hazardous foreign substance to remain on the floor, not warning about this dangerous condition, and failing to place safety measures such as barricades or signs. Additionally, Dean argues that Castaway’s should have known about the hazardous condition due to its frequency and could have easily remedied it.
As a result of this alleged negligence, Dean claims she has suffered significant damages including medical expenses, bodily injury, pain and suffering, disability, mental anguish, and loss of enjoyment of life. The lawsuit seeks damages exceeding the minimum jurisdictional limits of the court but does not specify an exact amount.
