A Florida woman has filed a lawsuit against a major hotel chain, alleging negligence that led to her injury. Irma Santiago filed the complaint in the Circuit Court of the 6th Judicial Circuit in Pinellas County, Florida, on July 19, 2024, naming Hilton Hotels Corp., doing business as Home2 Suites by Hilton Largo, as the defendant.
According to the court documents, Santiago's complaint centers around an incident that occurred on July 23, 2023. On that day, Santiago was a guest at Home2 Suites by Hilton Largo located at 10145 Ulmerton Rd in Largo, Pinellas County. While sitting by the pool, she was struck by an umbrella that had come loose. The impact resulted in injuries to her head and neck. Santiago alleges that these injuries were directly caused by the negligence of Hilton Hotels Corp., its employees, servants, and agents.
The plaintiff claims that Hilton Hotels Corp. failed in several critical areas of responsibility. Specifically, she accuses the hotel of creating or allowing a dangerous condition to persist and failing to take action to remedy it despite having ample time to do so. Furthermore, Santiago asserts that the hotel did not warn her about this hazardous condition. As stated in the complaint: "The Defendant’s negligence by and through its employees, servants and/or agents consisted of...creating a dangerous condition or allowing such to remain...failing to take action to remedy the dangerous condition while such condition was known or should have been known...and failing to warn the Plaintiff of the dangerous condition."
Santiago's injuries have had severe consequences on her life. She has suffered pain and incurred medical expenses due to her injuries. Additionally, she has experienced physical handicaps and scarring which have impaired her ability to work and resulted in lost wages. Her capacity for enjoying life has also diminished significantly due to these permanent and continuing injuries.
In light of these grievances, Santiago is seeking compensatory damages exceeding $50,001 from Hilton Hotels Corp. She demands a trial by jury for all issues triable as of right by a jury.
